Mackin Book Company d/b/a Mackin Educational Resources (“Mackin”, “we”, or “us”) is committed to protecting the privacy of our users. We take the issue of privacy very seriously, and we work hard to ensure your trust in Mackin and the services we provide. Mackin has developed policies and procedures regarding the collection, use, and disclosure of personally identifiable information and non-personal information we receive from users of our e-commerce website (www.mackin.com).

We may need to change this policy from time to time in order to address new issues and reflect changes on our website. We will post those changes here so that you will always know what information we gather, how we use the information, and whether we will disclose the information to anyone. Mackin.com is intended for use by educators and administrators making purchasing decisions on behalf of their school, district, institution or program. It is not intended for individual consumers, nor is it intended for children. By using this website, you signify your acceptance of our Privacy Policy. If you do not agree to this policy, please do not use our website. Your continued use of the website following the posting of changes will mean that you accept the changes.

Information we collect and the ways we use it

Mackin collects information such as your first and last name, school/library affiliation, district or organization, job title, email address, school/library mailing address, and school/library phone number, when you register for a Mackin.com account, place an order, request support or information or participate in an online community, blog, or similar option, and otherwise utilize services. If you would like to review your registration information and/or make changes, you can do so at any time by going to the My Account section on Mackin.com.

All the information gathered is used to personally identify users authorized to make purchases or otherwise utilize services on behalf of their district or organization. Mackin uses information for the following purposes:

  • Complying with the requirements of our contracts with districts, consortia, or other organizations which you represent as a purchasing agent
  • Notifying you of shipments, order confirmations, acknowledgments of requests, resource additions, and subscription expirations
  • User authentication or personalization of content
  • Activities necessary to perform authorized school or educational purposes and security of users
  • Integrating with additional service providers for use of the services
  • Notifying you of opportunities to provide feedback

Additionally, the information you provide may be deidentified for marketing and statistical purposes by Mackin.

Information we collect automatically

The website may collect certain information about your visit, such as the name of the Internet service
provider and the Internet Protocol (IP) address through which you access the Internet; the date and
time you access the website; the pages that you access while at the website; the Internet address of the
website from which you linked directly to our site; and account information including search and display
preferences as well as language and format settings. This information is used to help improve our
website, analyze trends, and administer the website.

Cookie/Tracking Technology – The website may use cookie and tracking technology depending on the
features offered. Cookie and tracking technology, including session cookies and analytics cookies, are
useful for gathering information such as browser type and operating system, tracking the number of
visitors to the website, and understanding how visitors use the website. Cookies can also help customize
the website for visitors. Personal information cannot be collected via cookies and other tracking
technology; however, if you previously provided personally identifiable information, cookies may be tied
to such information. Mackin does not use cookies for advertising or remarketing. You may refuse the
use of cookies by selecting the appropriate settings on your browser; however, please note that if you
do this you may not be able to use the full functionality of this website.

Analytics – This website has integrated the component of Google Analytics as a web analytics service.
The purpose of the Google Analytics component is to analyze the traffic on our website to help us
optimize system performance and improve website functionality. Mackin does not use Google Analytics
to collect any personally identifying information from users.

Payment Processor – PayTrace, Inc. processes all credit card transactions. PayTrace is fully compliant
with the Payment Card Industry Data Security Standards (PCI/DSS) and is committed to providing secure
online services. All encryption complies with international standards. Encryption is used to protect the
transmission of personal information when completing online transactions. PayTrace servers are
protected by firewalls and intrusion detection systems. Mackin does not have access to credit card
details. PayTrace continually reviews and enhances its security to be on the forefront of technology
security.

 

How we share information collected through our website

Mackin will never sell or trade your personal information to third parties. We may share or disclose information in the following ways:

  • We may share or disclose information with service providers that assist us in performing business-related functions that support or improve our services.
  • We may share or disclose information if we believe in good faith that doing so is necessary or appropriate to (a) protect or defend the rights, safety, or property of Mackin or third parties, (b) enforce our Privacy Policy, our Terms of Use, or any other legal agreement or contractual arrangement or (c) comply with law enforcement, legal, or regulatory process, such as to respond to a warrant, subpoena, court order, or other applicable laws and regulations.
  • We may share or disclose information with your consent or at your direction.
  • We may share or disclose information in connection with or during negotiations of any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. If such transfer is subject to additional mandatory restrictions under applicable laws, Mackin will comply with such restrictions.

How long we keep information

Mackin generally retains information when it is deemed relevant to business purposes. We may decide to anonymize or delete information that is no longer needed. We do not routinely delete stored user information unless specifically requested by the district or organization. However, Mackin will dispose of or return any user information upon request at contract end.

How we protect your information

Mackin takes the security and privacy of your data very seriously. For these reasons, we have implemented various technical, administrative, and physical safeguards to protect your information. These safeguards vary depending on the sensitivity of the information at issue.

Mackin is committed to preventing unauthorized access to our systems and data. We have procedures in place to investigate and mitigate any possible occurrence. In the event of a breach of personal data, Mackin will comply with all relevant laws.

Privacy information for California residents

Effective January 1, 2020, the California Consumer Privacy Act (“CCPA”) requires provision of information about how we collect, use, and share your “personal information” (as defined in the CCPA). We describe the categories of information we collect, our business purposes for collecting such information, the sources and uses of such information and the entities to which we share such information through this Privacy Policy.

CCPA Rights: Specifically, if you are a California resident and consistent with California law, you (or your authorized agent acting on behalf of you) may annually request that we:

  • provide you with information about the categories of personal information we collect, disclose or sell (see “No Sale Personal Information” below) about you; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we share personal information. Such information is also set forth in this Privacy Policy.
  • provide access to certain information we hold about you;
  • delete certain information we have about you; and/or
  • provide you with information about the financial incentives that we offer to you, if any.

Exercising CCPA Rights: Please note that certain information may be exempt from such requests under California law such as business contact information. Further, you must first verify your identity before we take any further action on your requests. You may submit a written information request to Mackin to the address at the end of this document. Mackin will respond within the CCPA-required 45-day timeframe.

No Sale of Personal Information: The CCPA sets forth certain obligations for businesses that “sell” personal information. Mackin does not engage in “sell[ing]” personal information (as defined by the CCPA) and has not engaged in such activity in the past twelve months, including for minors under 16 years of age.

Notice to EU residents

Mackin takes numerous measures to align with requirements of the General Data Protection Regulation (GDPR) for our users in the European Union. Mackin functions as the Controller of personal data because it “determines the purposes and means of data processing” for data collected by its service. Certain personal data, such as an email address, may be submitted by a user directly to Mackin. Other personal data, such as a cookie identifier or device identifier, may be collected by Mackin during a user’s interaction with the service. Mackin determines the purpose and legal basis for such data being collected (e.g., an email address is required in order to receive a shipment notification). It is important to note that our services have been designed to collect and process only the personal data that is necessary to provide the requested services to the user.

All data is saved on servers in the United States, at our data center located in our headquarters in Burnsville, Minnesota.

Additionally, as required of Controllers by GDPR, users can contact Mackin directly to exercise their rights to personal data access, rectification, portability, objection, and erasure (see below for more information). Mackin will respond to all requests within the GDPR-required 30-day timeframe. By submitting a written request using the contact information located at the end of this document, you can:

  • Review your personal information,
  • Obtain a copy of your information,
  • Request to have your information deleted, and
  • Revoke consent for information collection.
